Deportation breaches rights, says extremist

An extremist Muslim "preacher of hate" jailed for inciting murder is fighting Home Office attempts to deport him by claiming he has a human right to live with his family in the UK.
Sheikh Abdullah El-Faisal - an associate of Abu Hamza and a "strong" influence on Jermaine Lindsay, one of the July 7 bombers - is drawing close to release from prison, where he is serving a seven-year term imposed in March 2003.
He was convicted in relation to recordings of hate-filled speeches in which he urged the killing of Jews, Hindus, Americans and non-believers in Islam. He was also found guilty of stirring up racial hatred.
It is understood the Home Office is trying to deport Faisal, a convert to Islam, to his native Jamaica and has already won a judgment in its favour in an immigration tribunal. The judge who sentenced him in 2003 said he should be deported. He was originally jailed for nine years though the sentence was reduced to seven by the Court of Appeal.
However, Faisal is said to be planning to challenge this in the High Court, citing Article Eight of the European Convention on Human Rights, which enshrines the right to privacy and a family life.
Faisal, 43, a twice-married father of three, has a British wife and a family in London.
His solicitor, Khalid Sofi, confirmed that Faisal was challenging deportation primarily on the family point. In 2001, he was granted leave to remain in the UK because of his family.
However, the Home Office has argued that, as a result of his conviction and the judge's recommendation for deportation, his presence in the UK is "not conducive" to the public good.
Faisal preached at Brixton mosque in south London, urging his followers to "fly planes, drive tanks, load your guns" and use nuclear missiles to kill "all unbelievers".
